Terms and conditions
1. Scope of Application
The following terms and conditions (AGB) apply to all orders placed through our online shop by consumers and entrepreneurs.
A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their self-employed professional activity. An entrepreneur is a natural or legal person or a legal partnership with the capacity to conduct legal transactions who acts in the exercise of their commercial or self-employed professional activity when concluding a legal transaction.
2. Contracting Party, Conclusion of Contract
The purchase contract is concluded with MARAWE GmbH & Co. KG.
The presentation of products in the online shop is not a legally binding offer but rather a non-binding online catalog. You can initially add our products to your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose during the ordering process. By clicking the "Order with obligation to pay" button, you place a binding order for the goods in the shopping cart. Confirmation of the receipt of your order will be sent to you by email immediately after submitting the order.
The timing of the contract between us depends on the payment method you have chosen:
Advance payment by bank transfer
We accept your order by sending a separate email with an acceptance statement that includes our bank details.
PayPal
During the order process, you will be redirected to the PayPal online provider's website. There, you can provide your payment details and confirm the payment instruction to PayPal. After placing the order in the shop, we will request PayPal to initiate the payment transaction, thereby accepting your offer.
Direct Debit
After placing the order, we will debit the purchase price from your account, concluding the contract with us.
Credit Card
By placing the order, you simultaneously provide us with your credit card details. After confirming your legitimacy as the rightful cardholder, we will prompt your credit card company to initiate the payment transaction and thereby accept your offer.
Purchase on Invoice
This service is provided by PayPal. You can provide your payment details on their website and confirm the payment instruction to PayPal. The contract is concluded when we send you an order confirmation by email.
Cash on Delivery
After placing your order, we will ship it. The purchase contract is then concluded when the shipping service provider delivers your order to you.
3. Contract Language, Storage of Contract Text
The language available for the conclusion of the contract is German.
We store the contract text and send you the order data, which contains all contract details, by email. Additionally, you can download and save it directly after placing the order.
4. Shipping Costs
In addition to the stated product prices, shipping costs apply. Further information on the amount of shipping costs can be found in the offers.
5. Payment
Advance Payment
If you choose the advance payment option, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment.
Credit Card
By placing the order, you provide us with your credit card details. After verifying your legitimacy as the rightful cardholder, we will promptly request your credit card company to initiate the payment transaction. The payment transaction is automatically carried out by the credit card company, and your card will be charged.
PayPal
During the order process, you will be redirected to the PayPal online provider's website. To make the payment via PayPal, you must be registered there or register for an account, authenticate with your login credentials, and confirm the payment instruction to us. After placing the order in the shop, we will request PayPal to initiate the payment transaction.
The payment transaction is automatically processed by PayPal immediately afterward. Further information will be provided during the ordering process.
SOFORT Direct Transfer
After placing the order, you will be redirected to the SOFORT Überweisung online provider's website. To make the payment via SOFORT Überweisung, you must have an online banking account enabled for SOFORT Überweisung with a PIN/TAN procedure, authenticate accordingly, and confirm the payment instruction to us. Further information will be provided during the ordering process. The payment transaction is immediately carried out by SOFORT Überweisung, and your account will be charged.
6. Retention of Title
The goods remain our property until full payment is received.
For entrepreneurs, the following additional clause applies: We reserve ownership of the goods until all claims arising from an ongoing business relationship have been settled in full. You are authorized to resell the reserved goods in the ordinary course of business; you assign all claims arising from this resale to us in advance, irrespective of any connection or mixing of the reserved goods with a new item, and we accept this assignment. You remain authorized to collect the claims, but we may also collect claims ourselves if you fail to meet your payment obligations.
7. Transport Damage
For consumers:
If goods with obvious transport damage are delivered, please report such defects to the carrier as soon as possible and contact us immediately. Failure to make a complaint or contact us will have no consequences for your statutory claims and their enforcement, especially your warranty rights. However, it will help us to assert our own claims against the carrier or transport insurance.
For entrepreneurs:
The risk of accidental loss and deterioration passes to you as soon as we have delivered the item to the carrier, freight forwarder, or person or institution otherwise designated to carry out the shipment. For merchants, the obligations for examination and notification of defects under § 377 of the German Commercial Code (HGB) apply. If you fail to make the notification required by § 377 HGB, the goods are deemed approved, unless it is a defect that was not recognizable during the inspection. This does not apply if we have fraudulently concealed a defect.
8. Warranty
Statutory warranty rights apply.
9. Liability
We are fully liable for claims due to damages caused by us, our legal representatives, or vicarious agents:
- bei Verletzung des Lebens, des Körpers oder der Gesundheit,
- bei vorsätzlicher oder grob fahrlässiger Pflichtverletzung,
- bei Garantieversprechen, soweit vereinbart, oder
- soweit der Anwendungsbereich des Produkthaftungsgesetzes eröffnet ist.
In cases of slightly negligent breaches of essential contractual obligations, the liability is limited to the foreseeable damage typical for the contract, unless there is a violation of life, body, or health. All other claims for damages are excluded.
10. Dispute Resolution
The European Commission provides an online dispute resolution (OS) platform, which you can find at https://ec.europa.eu/consumers/odr.
We are not obligated or willing to participate in a dispute resolution procedure before a consumer arbitration board.
11. Final Provisions
If you are an entrepreneur, German law applies, excluding the UN Sales Convention. If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our place of business.
